About the “Legal Aid Cell”
Under the Legal Aid Committee, which was established in 1971, Justice P.N. Bhagwati initially launched the Legal Aid scheme. In his words, "legal aid" refers to setting up a system in society so that those who need it to enforce their legal rights can easily access the missionaries of justice. "The impoverished and illiterate should be able to approach the courts, and their ignorance and poverty should not be an impediment in their obtaining justice from the courts," he says. Illiterate and impoverished people should have access to legal aid. Legal aid is described as providing legal assistance to the underprivileged and illiterate who lack access to the legal system. One requirement does not have to be a litigant to use legal aid. Anyone travelling can apply for legal aid.
According to Article 39A of the Indian Constitution, the State shall ensure that the legal system operates to promote justice on the basis of equal opportunity. In particular, the State shall provide free legal aid, by appropriate legislation or schemes or in any other way, to ensure that no citizen's opportunity to secure justice is denied due to an economic or other disability. The State is also required by Articles 14 and 22(1) to guarantee equality before the law and a legal system that upholds justice by giving everyone equal opportunities. Legal aid works to protect constitutional rights by the impoverished, oppressed, and weaker segments of society are granted equal justice, and the commitment is upheld in text and spirit. Law colleges are crucial to producing the nation's future legal administrators. Law schools have a responsibility to ensure that the poor have access to justice, but they also have a role to play in promoting the welfare of the populace. The creation of Legal Aid Clinics is the most effective way to fulfil this obligation. In addition to raising public understanding of the law, one of the primary goals of these clinics is to make legal education more appealing. It aims to engage citizens in public policy and give them the confidence to confront their rights. Arham Law College established the Legal Aid Cell in accordance with these standards in order to assist those in need, offer legal advice, and set up legal aid camps. Students are encouraged by this cell to raise understanding of the law in both urban and rural communities.
Objectives of the Cell
The goal of the Legal Aid Center's founding is to provide social-legal assistance and clinical legal education to the underprivileged and vulnerable populations in the community. Since studying law is a professional degree, it is imperative that law students be exposed to the practical aspects of the legal industry. The Legal Aid Centre seeks to accomplish this goal while also offering a forum for helping the underprivileged.
The creation of efficient methods for providing legal services and legal education is its ultimate goal. It was intended to be used for the betterment of the underprivileged in addition to being a desirable learning tool to broaden the scope and comprehension of government-designed public spaces and programmes. This seeks to raise awareness among society's broader populace.
Functions of the Cell
To decide where to set up camps for legal aid.
- To get pupils ready for speeches, street plays, and short videos that aim to raise awareness among the intended audience.
- To offer free legal aid in the form of fundamental legal knowledge, lawsuit filing, payment, etc.
- To set up regular lectures for students about legal aid services every two weeks in order to instill a seriousness about serving society.
- To avoid bringing local residents' problems before the courts by using conciliation and mediation to settle them.
